These Terms of Service govern your use of soleandspark.com and any purchase you make here. Sole & Spark is a brand operated by Third Party Services LLC, a Kentucky limited liability company ("we," "us," or "our"). By browsing this store or placing an order, you agree to these terms. If you do not agree, please do not use the store.
1. Who can order
By placing an order you confirm that you are at least 18 years old, or that you have permission from a parent or guardian who accepts these terms on your behalf.
2. What we sell
Sole & Spark sells body jewelry: anklets, toe rings, sets, and gift boxes. Most pieces are adjustable and made for warm-weather wear with plated finishes. Descriptions and images are as accurate as we can make them, though screens vary and small variations between pieces are part of how they are made.
The Mystery Box contains three to five surprise pieces drawn from the collection. Its exact contents are chosen by us and vary between boxes. That is the point of it.
3. Prices and payment
Prices are in US dollars. Payment is processed by Stripe, and by checking out you agree to Stripe's terms and authorize the charge. We never see or store your card number.
Prices can change at any time before you buy. Once your order is placed, your price is locked. Your card statement will show THIRD PARTY SERVICES, the company that operates this store.
If an item is listed at an obviously wrong price, or is out of stock after you order, we will contact you and refund you in full rather than ship something you did not intend to buy.
4. Shipping
Orders are processed quickly and every package ships with tracking. Delivery times depend on the carrier and your location. If a package is lost or arrives damaged, write to us and we will make it right.
You are responsible for giving us a correct shipping address. Any customs duties or import taxes on international orders are yours to pay.
5. Returns
Send it back within 30 days for a refund. No hoops. Email hello@soleandspark.com and we will take care of it. Items should come back in the condition you received them. Refunds go to the original payment method once the return arrives.
Please contact us before starting a chargeback. We would rather just fix it.
6. Imagery and AI disclosure
Product and lifestyle imagery on this site is created with AI-generated models. No real person's likeness is used. Imagery of the physical products reflects the pieces we ship.
7. Our content
The text, images, logos, and design of this store belong to Third Party Services LLC or its suppliers and are protected by copyright and trademark law. You are welcome to view and print pages for your own personal use. You may not republish our content, scrape or systematically copy the store, use our brand elements without written permission, or create derivative works from our material.
8. How you may use the store
You agree not to use this store to break any law, to send spam or harmful code, to try to gain unauthorized access to any system or account, to impersonate anyone, or to interfere with how the store runs for other people.
9. Disclaimers
The store is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the store will always be available or free of errors, or that every detail on it is complete and current. Jewelry is a personal item: if you have a metal sensitivity, please check the materials listed before ordering.
10. Limitation of liability
To the fullest extent permitted by law, Third Party Services LLC and its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this store or its products, even if we were advised such damages were possible.
Our total liability for any claim shall not exceed the greater of (a) what you paid us in the 12 months before the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
11. Indemnification
You agree to indemnify and hold harmless Third Party Services LLC and its members, employees, and contractors from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your breach of these terms, your use of the store, or your infringement of anyone else's rights.
12. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. If a dispute arises, we ask that you contact us first so we can try to resolve it directly. Failing that, disputes shall be resolved by binding arbitration in Hardin County, Kentucky, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court where necessary to protect intellectual property or prevent irreparable harm.
Disputes are handled individually, not as a class action or representative proceeding.
13. Changes and termination
We may update these terms. When we do we will change the date at the top of this page, and continuing to use the store means you accept the update. We may suspend or end access to the store for conduct that breaches these terms or is harmful to other customers or to us.
14. Severability
If any part of these terms is found unenforceable, that part will be narrowed to the minimum extent needed to make it enforceable, and everything else stays in force.
